Terms and Conditions

1. General

These Terms & Conditions apply between you as the customer ("Customer") and Smokify ("Smokify", "we", "us", "our"). By placing an order through our online store, you agree to these Terms & Conditions.

To purchase products from us, you must be at least 18 years old.

All purchases require mandatory identity and age verification through BankID.

Orders can only be delivered to the registered residential address associated with the Customer's BankID.

We reserve the right to refuse any order where we suspect unauthorized use, age fraud, or fraudulent activity.

2. Orders

Once an order has been placed, the Customer will receive an order confirmation by email.

Customers should carefully review the confirmation and contact customer support immediately if any information is incorrect.

3. Pricing and Payment

All prices are displayed in Swedish Krona (SEK) and include VAT unless otherwise stated.

Any shipping fees or additional charges will be displayed during checkout before the purchase is completed.

The final price is confirmed when Smokify sends the final order confirmation by email.

Smokify reserves the right to adjust prices up until the day before shipment in the event of changes in taxes, VAT rates, or other circumstances beyond our control.

Payment Methods

Payments are processed through the payment methods available at checkout.

Smokify uses Stripe as its payment service provider. All payment transactions are processed through secure and encrypted connections in accordance with industry security standards.

Available payment methods may include:

Credit and debit cards
Apple Pay
Google Pay
Klarna invoice and financing options

Available options may vary depending on your location and the payment provider's terms.

Secure Payments

Card payments and digital wallet payments are processed by Stripe.

Payment information is transmitted using secure encrypted connections and handled in accordance with PCI DSS requirements.

Smokify does not store any payment card details.

Additional verification may be required under Strong Customer Authentication (SCA) regulations, including:

BankID verification
3D Secure
One-time authentication codes
Other verification methods provided by your bank or payment provider
Apple Pay and Google Pay

When using Apple Pay or Google Pay, the respective provider's terms and privacy policies also apply.

Smokify is not responsible for the functionality or fees associated with these third-party services.

Klarna

If Klarna is selected as a payment method, the Customer also accepts Klarna's terms regarding payments, credit assessments, and personal data processing.

Smokify is not responsible for any fees, interest, or charges imposed by Klarna.

Customers are encouraged to review Klarna's terms before completing payment.

Fraud Prevention

We reserve the right to reject orders or payment methods if fraud is suspected or if payment authorization cannot be obtained.

Products remain the property of Smokify until full payment has been received, to the extent permitted by applicable law.

4. Subscriptions

Smokify offers subscriptions for selected products.

A subscription allows Customers to receive recurring deliveries based on the delivery interval selected during checkout.

The first order is processed immediately when the subscription is created. Future orders are automatically generated according to the chosen schedule until the subscription is modified, paused, or cancelled.

Managing Your Subscription

Customers may manage subscriptions through their account area, including:

Changing products
Updating delivery intervals
Viewing upcoming deliveries
Pausing subscriptions
Cancelling subscriptions

Changes must be made before the next scheduled payment date to affect the upcoming delivery.

Subscription Delivery Address

Subscription orders can only be delivered to the Customer's verified residential address associated with BankID.

Alternative delivery addresses are not permitted.

If the Customer changes their registered residential address, they must log in again to ensure the subscription reflects the updated address.

Subscription Shipping

Subscription deliveries are generally shipped free of charge unless otherwise stated.

Smokify reserves the right to select the most appropriate carrier and delivery method based on factors including:

Order contents
Weight and size
Order value
Delivery address

Customers cannot select a specific carrier unless explicitly stated.

Subscription Pricing

Subscription pricing is based on the product prices in effect at the time each recurring order is generated.

Prices may therefore change over time.

For significant price increases, Customers will be notified at least seven (7) days in advance and may cancel their subscription before the new pricing takes effect.

Subscription Payments

Recurring subscription payments are automatically charged using the payment method registered by the Customer.

If payment fails due to expired cards, insufficient funds, or declined transactions, Smokify may pause or cancel the delivery.

Customers will be notified and given the opportunity to update their payment details.

Cancelling a Subscription

Subscriptions continue until cancelled.

Customers may cancel or pause subscriptions at any time through their account or by contacting customer support.

Cancellation only affects future deliveries and does not affect orders that have already been processed.

Right of Withdrawal

Customers have the right to withdraw from each individual subscription delivery in accordance with Section 6.

5. Delivery

We currently deliver only within Sweden.

Normal delivery times are between 2–5 business days from order confirmation.

Smokify reserves the right to choose the most suitable delivery method and carrier.

Deliveries may be made to:

Pickup points
Home delivery services
Other designated collection locations
Shipping Costs

Shipping costs are displayed during checkout.

Free shipping may be offered above a specified order value.

Tracking

For trackable shipments, tracking information is available in the Customer's account under "Orders."

Delivery Requirements

To ensure secure delivery:

Orders are delivered only to the Customer's registered residential address.
c/o addresses are not accepted.
Valid identification is required when collecting parcels.
Only the intended recipient may collect the shipment.
"Leave at door" delivery options are not available.

Risk for the goods transfers to the Customer upon receipt.

Customers should inspect their order immediately upon delivery.

Unclaimed Parcels

Parcels are generally held for collection for seven (7) days before being returned.

Smokify reserves the right to charge a fee of SEK 100 for unclaimed shipments to cover return shipping and handling costs.

Failure to collect a parcel does not constitute exercising the right of withdrawal.

Delivery Delays

If delivery cannot be completed within seven (7) business days, Smokify may cancel the order and issue a full refund.

If delivery is delayed by more than seven (7) business days beyond the promised delivery time, the Customer may cancel the purchase free of charge.

6. Right of Withdrawal and Returns

Consumers have the right to withdraw from a purchase within fourteen (14) days of receiving the goods under applicable distance selling legislation.

To exercise this right, Customers must notify Smokify via email, telephone, or the contact form on our website.

Returned products must be shipped within fourteen (14) days of notifying us.

Return Shipping

After contacting Smokify, Customers will receive return instructions and either:

A QR code
A return shipping label

If the provided return method is used, Smokify covers the return shipping cost.

Customers who choose alternative return methods are responsible for all shipping costs and any risk associated with transport.

Refunds

Refunds are generally processed within fourteen (14) days after we receive the returned goods or proof of return shipment.

Refunds are issued using the original payment method unless otherwise agreed.

We may reduce the refund amount if the product has been handled beyond what is necessary to determine its characteristics and functionality.

Exceptions

The right of withdrawal does not apply to:

Sealed products that cannot be returned for health or hygiene reasons once the seal has been broken, including nicotine products.
Customized or made-to-order products.

7. Complaints and Defective Products

Customers have the right to submit complaints regarding defective products in accordance with applicable consumer protection laws.

Complaints must be submitted within a reasonable period after the defect is discovered.

Complaints submitted within two (2) months of discovering a defect are always considered timely.

To file a complaint, Customers should provide:

Order number
Description of the defect
Photographs or other supporting documentation

If a complaint is approved, Smokify will cover return shipping costs.

Customers may be entitled to:

Repair
Replacement
Price reduction
Refund

depending on the circumstances and applicable law.

8. Force Majeure

Smokify shall not be liable for delays or failure to perform obligations due to circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to:

War
Government actions
Changes in legislation
Labor disputes
Fire
Flood
Natural disasters
Pandemics
Sabotage
Transportation disruptions

If a force majeure event continues for more than two months, either party may terminate the agreement without liability for damages.

9. Privacy

When you shop with us, we process your personal data in accordance with our Privacy Policy.

10. Disputes

Our goal is always to resolve any concerns directly with our customers.

If a dispute cannot be resolved, Customers may contact the Swedish National Board for Consumer Disputes (ARN).

Smokify agrees to comply with ARN's recommendations.
