• The customer attempts to obtain both a refund and a chargeback for the same transaction.
• The customer provides inaccurate or misleading information during the dispute process.

Smokekicker reserves the right to provide order records, shipping confirmations, delivery confirmations, communications, and other relevant evidence to payment processors, banks, and card issuers in order to contest chargebacks.

Where a chargeback is resolved in Smokekicker's favor, the customer remains responsible for any outstanding balance owed.

We reserve the right to refuse future orders, suspend customer accounts, or restrict access to our services where we reasonably believe a customer has engaged in fraudulent, abusive, or repeated chargeback activity.

Nothing in this section limits any statutory rights or consumer protections available under applicable law.

6. Shipping and Delivery

Smokekicker ships from Sweden to eligible destinations worldwide.

Delivery times are estimates only and are not guaranteed.

We are not responsible for delays caused by:

• Customs inspections
• Government authorities
• Postal services
• Couriers
• Force majeure events

Risk of loss passes to the customer upon delivery to the shipping carrier.

6.1 Customer Responsibility for Import Compliance

The customer is solely responsible for determining whether the products ordered from Smokekicker may be legally imported, possessed, purchased, received, or used in the destination country, state, province, territory, or other jurisdiction.

By placing an order, the customer confirms that:

• The importation of the ordered products is lawful in the destination jurisdiction.
• The customer meets all applicable age requirements.
• The customer has obtained any permits, licenses, registrations, or approvals that may be required under local law.
• The products are intended for personal use or any other lawful purpose permitted by applicable law.

Smokekicker does not provide legal advice regarding the laws or regulations of any particular jurisdiction and makes no representation that any product may be legally imported into a customer's destination country.

The customer assumes full responsibility for compliance with all applicable laws, regulations, customs requirements, taxes, duties, and import restrictions.

Smokekicker shall not be liable for any losses, damages, costs, penalties, confiscations, seizures, delays, destruction of goods, or other consequences arising from:

• Import restrictions or prohibitions.
• Customs inspections or enforcement actions.
• Regulatory actions by government authorities.
• Failure by the customer to comply with local laws or regulations.
• Refusal of entry by customs or border authorities.

Orders that are delayed, returned, seized, confiscated, abandoned, or destroyed by customs authorities or government agencies due to import restrictions or non-compliance with local laws may not be eligible for a refund, replacement, or reshipment.

The customer acknowledges and agrees that all purchases are made at their own risk with respect to importation into the destination jurisdiction.

7. Right of Withdrawal and Returns

Due to the nature of nicotine products, opened products cannot be returned.

Customers may request a return for unopened products within [14] days of delivery where permitted by applicable law. Customers must notify Smokify via email, telephone, or the contact form on our website. Returned products must be shipped within fourteen (14) days of notifying us. After contacting Smokify, Customers will receive return instructions.

Returned products must:

• Remain sealed and unused.
• Be in original condition.
• Be approved by Smokekicker before return shipment.

Shipping costs are non-refundable unless required by law.

Refunds will be processed using the original payment method.

Refunds are generally processed within fourteen (14) days after we receive the returned goods or proof of return shipment.

Exceptions

The right of withdrawal does not apply to:

Sealed products that cannot be returned for health or hygiene reasons once the seal has been broken, including nicotine products.

• Pandemics
• Sabotage

If a force majeure event continues for more than two months, either party may terminate the agreement without liability for damages.

14. Limitation of Liability
